DANIVINCIART
Privacy Policy
In the following privacy policy I inform you about the most important aspects of data processing in the context of my website danivinci.com. I collect and process personal data only on the basis of the statutory provisions (General Data Protection Regulation, Telecommunications Act 2003).
When we talk about data processing, we always mean your personal data. In the GDPR, this is defined in Art. 4 No. 1 as information relating to an identified or identifiable person. This refers to all data that relates to you (whether directly or indirectly), e.g. first name, surname, addresses, email addresses, user behavior, interests, etc.
Data related to online websites or services that do not belong to us or that we do not control are not part of this privacy policy.
As soon as you access or visit my website as a user, your IP address and the start and end of your session will be recorded once you have accepted the cookies. This is for technical reasons and therefore constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

01. PERSONAL DATA
If you contact me either via the contact form on the website or by email or place an order on the website, the data you send me will be stored by me for the purpose of processing your inquiry or in the event of further follow-up questions.
02. LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA
Insofar as I obtain the consent of the data subject for the processing of personal data, Art. 6 para. 1 lit. a of the General Data Protection Regulation (GDPR) serves as the legal basis. In the processing of personal data necessary for the performance of a contract to which the data subject is a party, Art. 6 para. 1 lit. b GDPR serves as the legal basis. This also applies to processing operations that are necessary for the implementation of pre-contractual measures. Insofar as the processing of personal data is necessary to fulfill a legal obligation to which my company is subject, Art. 6 para. 1 lit. c GDPR serves as the legal basis. In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 para. 1 lit. d GDPR serves as the legal basis. If the processing is necessary to safeguard a legitimate interest of my company or a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Art. 6 para. 1 lit. f GDPR serves as the legal basis for the processing.
03. DATA DELETION AND STORAGE DURATION
It is a general criterion for me that I only store personal data for as long as is absolutely necessary for the provision of my services and products. The data stored by me will be deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any statutory retention obligations.
In some cases, I am legally obliged to store certain data even after the original purpose no longer applies, for example for accounting purposes.
If you wish your data to be deleted or revoke your consent to data processing, the data will be deleted as quickly as possible and insofar as there is no obligation to store it.
If the user's data is not deleted because it is required for other and legally permissible purposes, its processing will be restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to user data that must be retained for commercial or tax law reasons. According to legal requirements, data is stored for 6 years in accordance with Section 257 (1) HGB (commercial books, inventories, opening balance sheets, annual financial statements, commercial letters, accounting vouchers, etc.) and for 10 years in accordance with Section 147 (1) AO (books, records, management reports, accounting vouchers, commercial and business letters, documents relevant for taxation, etc.).
04. PROTECTION AND DISCLOSURE OF PERSONAL DATA
I implement physical, technical and administrative security measures to adequately protect your personal data from loss, misuse, unauthorized access, disclosure and alteration. In addition, it is your responsibility to check that the personal data is accurate and up to date. I am not liable for the protection of personal data that I pass on to third parties on the basis of an account link authorized by you.
Data will only be passed on if this is essential, for example, for the fulfillment of my contractual obligations, if I have a legitimate interest or if I have your consent. Each of my contractual partners is conscientiously and carefully selected and I oblige them to protect all data in accordance with the statutory provisions. For this reason, I also conclude a contract data processing agreement with the processor (e.g. the print and dropshipping service provider Printful) in accordance with Art. 28 GDPR.
